This policy explains how JD& (JJD MKTG PTY LTD, ABN 77 691 981 530), referred to here as "we", "us" or "JD&", handles the personal information you give us. It covers our website at jd-and.com.au, our enquiry and onboarding forms, and the information we collect while working with you as a client.

We take your privacy seriously and we only collect what we actually need to do good work for you. We handle personal information in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).

The information we collect

Depending on how you deal with us, we may collect:

  • Contact details: your name, business name, email, phone number, and postal or business address.

  • Business and billing details: your ABN or ACN, entity type, the name of the person authorised to sign on the business's behalf, and any details we need to prepare a contract or invoice.

  • Documents you upload or send us: for example logos, brand guidelines, images, copy, or business registration documents you provide so we can set up or run your marketing.

  • Project information: details about your business, goals, customers, and existing marketing that you share with us through forms, calls, or email.

  • Website and technical information: when you visit our site, our hosting and analytics providers may collect standard technical data such as your device type, browser, and pages viewed, usually through cookies.

We generally do not seek sensitive information (such as health, racial, or political details). Please don't send it to us unless it's genuinely needed for the work, and even then only with your consent.

How we collect it

We usually collect personal information directly from you when you fill in a form on our website, email or message us, book or attend a call, sign a contract, or send us files during a project. Some technical information is collected automatically through our website when you browse it.

If we ever collect information about you from someone else (for example, a referral or a public business listing), we'll handle it the same way we handle information you give us directly.

  • respond to your enquiry and work out whether we're a good fit;

  • prepare proposals, contracts, and invoices, and take payment;

  • deliver the marketing services you've engaged us for;

  • set up accounts and listings on your behalf where you've asked us to (for example a business listing or advertising account);

  • keep in touch with you about your project and our services;

  • meet our record-keeping, tax, and legal obligations.

Who we share it with

We don't sell your personal information. We do share it in limited ways to run the business and deliver your work:

  • Our team: anyone contracted to JD& who needs it to work on your project, under the same privacy obligations we hold ourselves to.

  • The tools and platforms we use to operate: for example our website host, form provider, contract and invoicing software, accounting software, design tools, scheduling tools, and the advertising and business platforms we manage on your behalf. These providers only handle your information to provide their service to us.

  • Where the law requires it: for example to comply with a legal obligation or a lawful request from a government body.

Information stored or handled overseas

Some of the platforms we rely on are based outside Australia or store data on overseas servers (commonly in the United States). This means some of your information may be stored or handled outside Australia. Where that happens, we take reasonable steps to use reputable providers that handle information securely, but their handling is also governed by their own privacy terms and the laws of the country they operate in.

Storing and protecting your information

We take reasonable steps to keep your information secure, including using password-protected accounts and trusted software providers, and limiting who can access it. No system is ever completely secure, so we can't guarantee absolute security, but we treat your information carefully.

We keep personal information only for as long as we need it for the purposes above or to meet our legal and record-keeping obligations, and then we take reasonable steps to delete or de-identify it.

Marketing and how to opt out

Every marketing message includes a way to unsubscribe, and you can opt out at any time by using that link or by emailing us. We'll action opt-outs promptly. Opting out of marketing won't stop the essential messages we need to send you about your active project or account.

Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it's wrong or out of date. Just email us using the details below. We'll respond within a reasonable time. There's usually no charge, and if we can't give you access for some reason, we'll explain why.

Complaints

If you're unhappy with how we've handled your personal information, please get in touch with us first so we can try to sort it out. If you're not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Data breaches

If something goes wrong and a data breach happens that is likely to cause serious harm, we'll take it seriously, act to contain it, and notify affected people and any relevant authority where we're required to.
